Terms and Conditions

1. GENERAL PROVISIONS


GREATEBIKE.EU is operated by ekolo.cz s.r.o., with registered office at K letišti 1151/2, Ruzyně, 161 00 Prague 6, Czech Republic. Company Identification No. (IČO): 27141659, VAT ID (DIČ): CZ27141659, incorporated in the Commercial Register maintained by the Municipal Court in Prague, Section C, File No. 99425.

These Terms and Conditions (“Terms”) govern the rights and obligations between ekolo.cz s.r.o.(“Seller”) and the buyer (“Buyer”) arising from purchase agreements concluded via the online shop located at www.greatebike.eu.

The Buyer is either a consumer (a natural person not acting in the course of their trade or profession) or an entrepreneur (a person acting in the course of their trade or profession). Provisions designated as applicable to consumers apply only to consumers; in case of conflict, mandatory consumer-protection provisions of EU law and Czech law (in particular Act No. 89/2012 Coll., the Civil Code, and Act No. 634/1992 Coll., on Consumer Protection) prevail.

The Seller accepts no liability (to the fullest extent permitted by law) for the accuracy of the information contained on this website or in related advertising, which may contain technical inaccuracies or typographical errors. This provision does not affect the Buyer’s statutory rights.

If the Seller is responsible for any error in product description, the Buyer will be given the opportunity to cancel and return the order and receive a full refund, including any shipping costs.

 

2. PRODUCT INFORMATION


2.1 Products

Greatebike.eu displays products for sale on its website together with the essential characteristics required to enable the consumer to make an informed purchase decision before placing an order.

The descriptions, specifications and illustrations of the products are prepared with the greatest care. Errors and modifications can occur. Where such disparities are not the Seller’s fault, the Seller assumes no responsibility for them; the Buyer’s statutory rights remain unaffected, and section 1 above applies in cases of error in product description for which the Seller is responsible.

2.2 Availability

If a product is unavailable (in particular due to supplier issues), the Buyer will be informed as soon as possible and will be entitled to cancel or modify the order. Any payment already made will be refunded without undue delay, no later than 14 days from the cancellation.

2.3 Pricing

All prices are stated in euros (EUR) and include VAT applicable on the day of the order. Any change in the VAT rate is automatically reflected in the prices shown online.

Prices do not include shipping costs, which are added to the final invoice and clearly indicated before the final confirmation of the order, in line with Article 6(1)(e) of Directive 2011/83/EU.

Payment of the total order amount must be completed during the order process. No payment shall be considered a deposit.

In the case of an export sale outside the EU, all applicable taxes and customs duties in the Buyer’s country are the responsibility of the Buyer.

Greatebike.eu reserves the right to modify pricing. Any pricing modification will be communicated to the Buyer before the order is accepted and will not affect orders already confirmed.

 

3. SUBJECT OF THE SALES CONTRACT


3.1 Implementation

Upon conclusion of a Sale and Purchase Agreement, the Seller undertakes to deliver the object of the purchase to the Buyer and to transfer ownership of the object to the Buyer.

3.2 Obligations of the Buyer

Upon conclusion of the Sale and Purchase Agreement, the Buyer undertakes to accept the delivered goods and to pay the agreed purchase price to the Seller (or to the Carrier on the Seller’s behalf where applicable).

3.3 Subject of the purchase

The subject of the purchase is the goods specified in the Buyer’s order in terms of manufacturer, name, type, quantity, weight, dimensions and price.

3.4 Conclusion of the contract

The presentation of goods on the website is not a binding offer within the meaning of § 1732 (2) of the Czech Civil Code. The Buyer’s order constitutes a binding offer to enter into a purchase agreement. The contract is concluded upon delivery of the order confirmation by the Seller to the Buyer’s email address.

The Seller archives the concluded contract for the purpose of its performance and makes it accessible to the Buyer on request. The contract is concluded in English (or in the language of the localised version of the website chosen by the Buyer).

 

4. ORDERS


The Buyer may place an order 24 hours a day via the integrated shopping cart on greatebike.eu, by email, or in writing at the Seller’s address. Orders placed via the online shop are confirmed by default within 24 hours, and no later than the next business day if placed at the weekend. The Buyer will receive an order confirmation by email and will also be notified by email when the goods are dispatched.

For some orders (high-value goods, large quantities, etc.), the Seller will contact the Buyer by email or telephone to confirm and refine the order.

Until the purchase price is paid in full, the goods remain the property of the Seller (retention of title). The risk of damage to the goods passes to the Buyer at the moment of receipt of the goods (see also section 6).

4.1 Payment methods

Payment is made by payment card, Apple Pay, Google Pay or bank transfer. The order is confirmed only once payment has been received by greatebike.eu.

 

5. DELIVERY


The Seller delivers to all EU member states and to Switzerland, Norway and Liechtenstein (EFTA).

Price and delivery time vary by destination. For simplicity, shipping costs are divided into 4 zones. For details, see Delivery information.

Logistics for GREATEBIKE.EU are provided by Kuehne + Nagel for e-bike deliveries (https://home.kuehne-nagel.com/) and by GLS for small parcels (https://gls-group.com/).

The standard delivery time is indicated on the product page or communicated in the order confirmation. If the Seller is unable to deliver within the agreed time, the Buyer may set an additional reasonable period; if delivery does not occur within that additional period, the Buyer is entitled to withdraw from the contract.

 

6. WARRANTY AND LIABILITY FOR DEFECTS


6.1 Statutory rights of consumers

For Buyers who are consumers, the Seller is liable for defects existing at the time of delivery and for defects appearing within 24 months of delivery, in accordance with Directive (EU) 2019/771 and § 2165 of the Czech Civil Code. This statutory liability is not affected by these Terms.

If a defect appears within 12 months of delivery, it is presumed that the defect existed at the time of delivery, unless the contrary is proven or unless the presumption is incompatible with the nature of the goods or the defect (Article 11 of Directive (EU) 2019/771).

In the case of a defect, the consumer is entitled to:

  • repair or replacement of the goods free of charge,

  • a proportionate price reduction, or

  • withdrawal from the contract,

under the conditions laid down by applicable law.

6.2 Inspection on receipt

The Buyer is required to inspect the goods upon receipt. If mechanical damage is found on the packaging, the Buyer should check the condition of the goods and, if damage is found, record this in the presence of the Carrier’s representative.

The Carrier is liable for damage during transport; all goods are insured. On the basis of a written record, the Buyer will be offered a reasonable price reduction or replacement after the loss event has been settled with the Carrier. By signing the consignment note without remarks, the Buyer confirms receipt of the goods in good order.

The Buyer’s right to claim defects is not affected by signing the consignment note in respect of defects that could not have been discovered upon ordinary inspection.

6.3 Use of the goods

Before using the goods for the first time, the Buyer is obliged to read the operating instructions and warranty terms and to follow them. In the case of improper use, the Buyer is liable for any resulting damage.

6.4 Exclusions

The warranty does not cover:

  • normal wear and tear caused by ordinary use,

  • defects expressly disclosed to the Buyer before the conclusion of the contract,

  • damage caused by the Buyer or third parties (improper use, mechanical damage, exposure to extreme conditions, unauthorised modifications, etc.),

  • defects caused by external events occurring after the risk of damage has passed to the Buyer.

6.5 Complaints procedure

The Seller will handle complaints without undue delay, and in any case within 30 days from the date the complaint is lodged, in accordance with § 19 (3) of Act No. 634/1992 Coll. The 30-day period may be extended only by express written agreement with the Buyer-consumer.

To submit a complaint, please contact the Seller at info@greatebike.eu with the order number, a description of the defect and supporting photographs where possible. The Seller will provide instructions for returning the goods.

The risk of damage to the goods passes to the Buyer upon receipt of the goods from the Carrier. If the Buyer fails to take delivery of goods made available to them, the risk of accidental loss or damage passes only at the moment when the Buyer-consumer would have ordinarily taken receipt, in accordance with Article 20 of Directive 2011/83/EU and § 2123 of the Czech Civil Code.

6.6 Transport damage

The Seller asks customers to report obvious quality defects within one week of receipt. In the case of externally visible transport damage, the Buyer should check the parcel immediately and ask the Carrier for written confirmation of the damage.

6.7 Out-of-court (alternative) dispute resolution

In accordance with Act No. 634/1992 Coll., on Consumer Protection, the consumer has the right to refer a consumer dispute arising from this contract to out-of-court (alternative) dispute resolution. The competent body for out-of-court resolution of consumer disputes is the Czech Trade Inspection Authority (Česká obchodní inspekce, ČOI):

7. RIGHT OF WITHDRAWAL (RETURN POLICY) FOR CONSUMERS


7.1 14-day right of withdrawal

In accordance with Article 9 of Directive 2011/83/EU and § 1829 of the Czech Civil Code, a Buyer who is a consumer has the right to withdraw from the purchase contract concluded via the online shop within 14 days of the day on which the consumer (or a third party indicated by the consumer, other than the carrier) takes physical possession of the goods, without giving any reason and without incurring any costs other than those provided for in this article.

To exercise the right of withdrawal, it is sufficient to send the notice of withdrawal before the 14-day period expires. The notice does not need to be received by the Seller within that period.

7.2 How to withdraw

7.3 Effects of withdrawal

If the Buyer withdraws from the contract, the Seller will refund all payments received from the Buyer, including the costs of standard delivery, without undue delay and within 14 days from the day on which the Seller is informed of the withdrawal.

The refund will be made using the same means of payment that the Buyer used for the original transaction, unless the Buyer has expressly agreed otherwise. In any event, no fees will be charged to the Buyer for the refund.

The Seller may withhold the refund until the goods have been received back, or until the Buyer has supplied evidence of having sent the goods back, whichever is earlier.

The Buyer must send the goods back to the Seller (at the address stated in section 7.2) without undue delay and in any event no later than 14 days from the day on which the Buyer communicates the withdrawal. The deadline is met if the Buyer sends the goods back before the 14-day period has expired.

The Buyer bears the direct costs of returning the goods. For e-bikes and other large items, these costs may be substantial; due to the size and weight of e-bikes, these costs are typically in the range of EUR 80–250 per unit, depending on destination and carrier. These goods cannot normally be returned by ordinary post.

7.4 Diminished value of the goods

The Buyer is liable only for any diminished value of the goods resulting from handling other than what is necessary to establish the nature, characteristics and functioning of the goods, in accordance with Article 14(2) of Directive 2011/83/EU.

This means the Buyer may unpack, inspect and test the goods in the same way as they would in a brick-and-mortar shop. The Buyer is not required to return the goods in the original packaging or in unused condition as a precondition for exercising the right of withdrawal. However, where the goods have been used beyond what is necessary to establish their nature and functioning, the Seller is entitled to deduct the corresponding diminution in value from the refund.

To facilitate safe return, the Seller recommends (but does not require) that the Buyer keep the original packaging for at least one year after purchase. 7.5 Exceptions to the right of withdrawal

The right of withdrawal does not apply to contracts listed in Article 16 of Directive 2011/83/EU and § 1837 of the Czech Civil Code, in particular to:

  • goods made to the consumer’s specifications or clearly personalised,

  • goods which are liable to deteriorate or expire rapidly,

  • sealed goods unsuitable for return for reasons of health protection or hygiene and which were unsealed after delivery.

7.6 Voluntary exchange policy

In addition to the statutory right of withdrawal, the Seller offers an exchange of goods within 30 daysof purchase, provided the goods are returned in saleable condition. The value of the new goods must be equal to or higher than that of the originally purchased goods. This exchange policy is a voluntary contractual extension and does not affect the statutory right of withdrawal under section 7.1.

 

8. PERSONAL DATA PROTECTION


The Seller processes the Buyer’s personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Czech Act No. 110/2019 Coll., on Personal Data Processing. Details on the processing of personal data are set out in the Privacy Policy.

 

9. SUPERVISORY AUTHORITIES


Supervision of compliance with consumer-protection legislation is carried out by:

  • Czech Trade Inspection Authority (Česká obchodní inspekce) – www.coi.cz

  • Office for Personal Data Protection (Úřad pro ochranu osobních údajů) – www.uoou.cz

  • Trade Licensing Office of the Capital City of Prague (Živnostenský úřad MČ Praha 6) – for trade-licensing matters

 

10. FINAL PROVISIONS


10.1 Governing law and jurisdiction

The contractual relationship between the Seller and the Buyer is governed by the law of the Czech Republic, in particular Act No. 89/2012 Coll. (Civil Code) and Act No. 634/1992 Coll. (Consumer Protection Act), and by directly applicable EU consumer-protection law. This choice of law does not deprive a consumer of the protection afforded to them by mandatory provisions of the law of the country of their habitual residence (Article 6 of Regulation (EC) No 593/2008, Rome I).

10.2 Acceptance of the Terms

By clicking the “BUY” button on the order page, the Buyer confirms that they have read and accept these Terms and Conditions in the version effective at the time the order is placed.

10.3 Changes to the Terms

The Seller reserves the right to amend these Terms. The legal relationship between the Seller and the Buyer is always governed by the version of the Terms in force at the time the order was placed.

10.4 Severability

If any provision of these Terms is or becomes invalid or unenforceable, the validity of the remaining provisions shall not be affected.
